1. I understand there is a yearly $10 plot fee due one week after receiving notification of my plot assignment. Fees will offset continuing maintenance and repair costs, as well as replacement costs for lost or damaged tools. Plot fees are non-refundable.
2. I understand the terms of agreement are for one year.
3. If I must abandon my plot for any reason, I will notify the garden coordinator. Refunds will not be given for abandon plots. Plants and related property left in the garden bed will become property of the City of Ocala.
4. I will not leave my plot unmaintained for any period of time exceeding two or more weeks without making arrangements for my plot’s care.
5. Maintenance of my garden plot is my sole responsibility. I will water as needed, remove weeds promptly, report disease or insect infestations, properly remove contaminated plants, and harvest produce in a timely manner.
6. I understand that the application of herbicides and pesticides (weed killers) to my garden plot is prohibited.
7. I understand that it is my responsibility to maintain plants within the limits of my plot and to keep vegetation less than seven feet in height, so as not to shade neighbor’s plots.
8. I will not grow illegal plants in the garden.
9. I will keep trash and litter cleaned from the plot, as well as from adjacent pathways and fences.
10. I will sort waste from my plot into compost, recyclables, and trash. There will be designated bins for compost, recyclables, and trash. I will place waste into the correct designated bin.
11. I will respect the garden’s property and assets, use equipment and tools owned in common responsibly and treat them with care, clean and return them to the shed after use, and store them neatly and securely. I will not remove equipment furnished by the Ocala Community Garden from the garden. I will lock the shed and gate each time I leave.
12. I will turn off water at designated location after use and coil all hoses neatly on the post provided. I will not drag hoses through other gardeners’ plots.
13. I will harvest only my own crops unless given permission by another plot user. I will harvest my plot crops when ripe; and I will not allow my crop to rot. If I cannot or do not wish to harvest my crop, I will notify the garden coordinator so that arrangements can be made to harvest my plot to donate the produce.
14. I will participate in the regular cleanup and maintenance, as well as fall cleanup of the garden.
15. I will be respectful of other gardeners: I will not enter others’ plots; I will not water others’ plots and will not barrow or remove anything from the plots of other gardeners.
16. I will work to keep the garden secure and an enjoyable place where all participants can garden and socialize peacefully in a neighborly manner.
17. I will not bring pets to the garden.
18. I understand that children of all ages are welcome but must be supervised by a parent or guardian at all times.
19. I understand that I may bring guests to the garden. Guests are also subject to all rules, terms, and conditions stated here. Gardeners are solely responsible for the behavior of their guests.
20. I understand that the gardeners are not permitted to smoke, drink alcoholic beverages, use illegal drugs, or gamble at the garden site.
21. I will not sell my produce on premise.
22. I agree to park in the designated Ocala Community Garden parking area only and to respect the residents of the area.
23. I understand and willingly accept the inherent risks in gardening. I understand that use and misuse of gardening tools may result in injury. I am aware that the soil and food-borne diseases, though rare, may be contracted through gardening or consuming undercooked foods.
24. I understand that, participation in the Ocala Community Garden is a privilege and if I fail to comply with the terms of this application, my gardening privileges and the plot may be forfeited. If there is no response or correction made within 14 days, the plot will be forfeited.
25. I understand, acknowledge and agree to waive and release any and all claims, or rights for any injury, death, or damages while in the Ocala Community Garden and that neither the Ocala Community Garden entities nor any of its directors, officers, employees, agents, lessors, affiliated companies of foundations have any liability to me or Ocala Community Garden and I waive and release the aforementioned parties from any claims that I may have, whether based on tort, contract or otherwise, resulting there from.
26. I understand, acknowledge and agree to indemnify and hold harmless the Ocala Community Garden entities and any of its directors, officers, employees, agents, lessors, affiliated companies or foundations.
